Administrative Review
You
must request an Administrative Review within 21 calendar days of receiving the
ticket, or within 14 calendar days from the mailing date of the first overdue
notice. There are three ways to request an Administrative Review. Select the

If
you are not satisfied with the results of the Administrative Review, you may
request an Administrative Hearing. You must request an Administrative Hearing
within 21 days of the date of the Administrative Review decision. Once those 21
days have passed, you are no longer entitled to an Administrative Hearing.
State
Law Requires That You Pay All Fines Owed On The Ticket Before You Can Request An
Administrative Hearing
If
the Hearing Officer finds in your favor, you will be issued a refund within 30
days of the date of the Hearing Officer’s decision.

The
Customer Service Representative (CSR) will submit a Hearing request for you. You
can also download a Hearing
Request Form
from the website. You will be sent written notification of your Hearing time,
date, and location within two months. Currently, the Parking Violations Bureau
has three convenient Hearing Office locations. For directions to your Hearing
Location, please click on one of the following addresses:
West

If
you would like a different location, other than the one closest to the place
that your ticket was issued, tell the CSR at the time you request the Hearing.
You also have the option of requesting a Hearing By Mail. If you select the
Hearing By Mail, you must submit your written reason for contesting the citation
and ALL evidence to support your case. With this option, you will not be present
for the hearing. For more information, please download the Hearing

You
will be scheduled for a Hearing date and, if requesting a Hearing In-Person,
notified of that date by mail. As required by the California Vehicle Code, your
Hearing date will not be later than 60 days after the initial request for a
Hearing.
What Happens At An
Administrative Hearing?
The
Hearing Officer will be provided with a case folder which contains all
information relevant to your ticket, including:
The
hearing officer will review this information and may consider additional
resources and evidence in determining the merits of the case. He/She will also
listen to your explanation of why the ticket should be dismissed OR review all
evidence submitted. Once the Hearing Officer has enough information, she/he will
end the Hearing. You will be notified by mail of the Hearing Officer's
determination. There are a number of decisions which the Hearing Officer can
make:
1.
Your
ticket is "Valid"; Your Late Fees are "Valid"
2.
Your
ticket is "Valid"; Your Late Fees are Canceled
3.
Your
ticket is "Not Valid"
If
the Hearing Officer decides that all or part of your fines should be dismissed,
you will be issued a refund within 30 days of the date of the Hearing Officer's
decision.
Please
arrive at your assigned Hearing location 5-10 minutes prior to your Hearing
time. If you receive notification of a Hearing time which is not convenient, you
may reschedule, by calling our Customer Service Hotline. YOU ARE ALLOWED ONLY
ONE RESCHEDULE.
Hearing Payment Waivers
Payment
Waivers are available for citizens whose financial situation qualifies them as a
very low income household, using guidelines established by the Department of
Housing and Urban Development. This waiver does NOT cancel your fine. It simply
allows you to attend a Hearing without first paying the fine required by state
law. If your ticket is found to be valid, you still must pay the fines.
You
will be required to provide detailed income information as part of your payment
waiver request. The PVB will consider all forms of income, including parental
support, while determining your eligibility for the waiver.

You
will be notified whether or not you have been granted a waiver by mail. You must
then request that a hearing be scheduled.

Appeal
If you are dissatisfied with the results of the Administrative Hearing, you may appeal the decision at Municipal Court. You must request an appeal within 30 days of the Hearing Officer's decision. You must file for the appeal in person at the Superior Court. There is a filing fee per ticket required by the Court, which will be refunded to you, if the judge rules in your favor. You will also need to present the written Administrative Hearing decision at the time the appeal is filed. The written administrative hearing decision is submitted as evidence for the court appeal. If you received a financial waiver to attend the Hearing without paying the ticket fine, you may request a similar waiver directly from the appeals court.

The Appeal is a hearing where the Court will review the decision of the Hearing Officer. You may not skip the Administrative Review or Hearing and file immediately for a Court ruling.
